In that case, the employee has to take the complaint to the NLRB office, for both the hostile working conditions and the retaliation.

I'm pretty sure it was a rhetorical question, and I cannot imagine that the NLRB would respond quickly. It's the highest rung on the harassment response ladder, so it's the least direct.

A lawsuit puts the company on a more equal footing to defend itself, but the gains are potentially much better than a harassment complaint can bring.
